James J. Kelley, II is a partner in Morgan Lewis's Labor and Employment Practice. Mr. Kelley is engaged in the full range of labor and employment law practice areas, including employment litigation, collective bargaining, grievance administration and arbitration, Department of Labor regulatory compliance (FLSA, SCA, Davis-Bacon and Walsh-Healy), preventative labor relations and protection of intellectual property through the employment relationship. Mr. Kelley also counsels private and public sector clients on the promulgation and structure of, Employee Assistance Programs, substance abuse, sexual harassment and workplace violence programs, and negotiates such programs with major industrial, transportation and service unions. He also provides advice regarding the Labor and employment law ramifications of business transactions for both selling and acquiring companies, and provides counseling on personnel law.
From 2005 through 2008, Mr. Kelley was named one of the leading U.S. lawyers for employment law by Chambers USA, based on the views of clients, peers and other industry professionals. Chambers has noted that Mr. Kelley is an "effective and practical" lawyer, whose practice covers both labor and employment and also has called Mr. Kelley "incredibly effective at dealing with labor unions and good at selling difficult deals."
Mr. Kelley has been a lecturer on industry labor relations and employment law issues at trade association and other client meetings throughout the U.S. for executive, industry and educational groups. In addition, Mr. Kelley has lectured on advanced employment law programs at the University of Virginia Law School, Washington and Lee Law School, Georgetown University Law Center and the University of Maryland Graduate Program in EAP Management.
Mr. Kelley is admitted to practice in the District of Columbia and Virginia and before the U.S. Supreme Court and the majority of the U.S. Courts of Appeals.
