Alvin H. Gutterman is a senior counsel in Morgan Lewis's Energy Practice. His practice focuses on nuclear licensing and litigation. Mr. Gutterman has an active role in counseling various electric utilities and NRC materials licensees on the development of nuclear licensing strategies, responding to NRC enforcement orders and investigations, compliance with NRC technical and reporting requirements, strategies for restart of shutdown plants, and other regulatory issues. He represents NRC licensees and their employees in NRC hearings and investigations. He also participates in representing them in litigation related to the conduct of their NRC licensed activities.
Mr. Gutterman has had lead responsibility for advising and representing clients on such matters as:
- Applications for exemptions and license amendments for the South Texas Project Electric Generating Station, the Duane Arnold Energy Center and Sequoyah Fuels Corporation.
- NRC investigations at Susquehanna Steam Electric Station, Trojan Nuclear Plant, South Texas Project Electric Generating Station, the Duane Arnold Energy Center, Sequoyah Fuels Corporation and the Paducah Gaseous Diffusion Plant.
- NRC hearings regarding license amendments, reactor operator licensing, enforcement and operating licenses for Palo Verde Nuclear Generating Station, Susquehanna Steam Electric Station, a contractor to the nuclear industry, Sequoyah Fuels Corporation and the South Texas Project Electric Generating Station.
- Responses to NRC enforcement actions at South Texas Project Electric Generating Station, the Duane Arnold Energy Center, Trojan Nuclear Plant, Sequoyah Fuels Corporation and the Paducah Gaseous Diffusion Plant.
- Decommissioning Plans for Sequoyah Fuels Corporation, Kaiser Aluminum and Chemical Company, and Texas Instruments.
Prior to joining Morgan Lewis in 1994, Mr. Gutterman was a member of Newman, Bouknight & Edgar, where his responsibilities included representation and providing legal counsel to the South Texas Project, Comanche Peak, the Duane Arnold Energy Center, Palo Verde and other nuclear power plants, as well as the Sequoyah Fuels Corporation. These activities included key roles in representation of Houston Lighting and Power Company in a contested NRC operating license hearing and in litigation regarding contractor design and construction activities.
Before entering the private practice of law, Mr. Gutterman was a member of the legal staff of the Tennessee Valley Authority, where his responsibilities included representing TVA in NRC proceedings related to the applications for construction permits or operating licenses for the Browns Ferry, Sequoyah, Watts Bar, Bellefonte, Hartsville, Phipps Bend and Yellow Creek nuclear power plants, and NRC rulemaking, advising TVA managers on licensing strategy, the development of TVA procedures for compliance with NRC requirements, preparation of environmental impact statements and reports, and development of responses to NRC enforcement orders.
