Kenneth A. Rubin is a partner in Morgan Lewis's Litigation Practice. Ever since his arrival in Washington, D.C. in the early 1970s, following some work at both the EPA and the Justice Department, Mr. Rubin has practiced exclusively in the field of environmental law.

Mr. Rubin has been extensively involved with litigation throughout the United States involving water issues and Superfund, both in trial courts and appellate litigation. He counsels corporate clients on compliance, environmental audits, and corporate due diligence regarding all applicable environmental laws, in particular the Clean Water Act, the Oil Pollution Act, the Resource Conservation and Recovery Act, the Safe Drinking Water Act, the Toxic Substances Control Act, the Clean Air Act, and the Emergency Planning and Community Right-To-Know Act. He was extensively involved in the application of the the National Environmental Policy Act and the Endangered Species Act to the allocation of water in central Texas, on behalf of the City of San Antonio. He has represented several projects with Coastal Zone Management Act consistency reviews.

Mr. Rubin is an active writer and lecturer. For 10 years he was the principal outside lecturer to the U.S. Army Corps of Engineers on environmental law and is now a visiting lecturer at the Cornell University Graduate School of Management. He has lectured in Japan on regulation of toxic substances in the United States and Europe. In 1975, Mr. Rubin wrote "The Role of the Coastal Zone Management Act of 1972 in the Development of Oil and Gas from the Outer Continental Shelf" for the Natural Resources Lawyer, a topic that remains important in environmental law. He continues to assist clients in obtaining state concurrence in CZMA Consistency Certifications.

Prior to entering private practice, Mr. Rubin served in the Office of General Counsel, Environmental Protection Agency and the Appellate Section, Environment and Natural Resources Division of the U.S. Department of Justice.

Mr. Rubin makes extensive use of his environmental engineering training and computer technologies, in conducting comprehensive environmental compliance audits and conducting due diligence for acquisitions. He has assisted several of the nation's largest corporations in making voluntary disclosures of noncompliance discovered during the course of these audits, using the EPA's "Self-Policing Policy," under which most violations detected as a result of these audits were resolved without penalty.

Mr. Rubin's master's thesis at Cornell University addressed the use of activated carbon and chlorine to convert municipal sewage into drinking water.

Mr. Rubin is listed in Who's Who in America and Who's Who in American Law. He is admitted to practice in the District of Columbia and before the U.S. Supreme Court and most U.S. Circuit Courts of Appeals.
