S. Sean Kundu is an associate in Morgan Lewis's Labor and Employment Practice. Mr. Kundu's practice focuses on defending employers in wrongful termination, discrimination, harassment, and wage and hour single-plaintiff and class action lawsuits under both federal and California laws, such as the California Fair Employment and Housing Act, the Fair Labor Standards Act, the Family Medical Leave Act, the California Family Rights Act, and other labor and employment laws. He has represented clients and appeared before governmental agencies, such as the Department of Fair Employment and Housing and the Department of Labor Standards Enforcement, as well as state and federal courts. Mr. Kundu also counsels employers on various employment related issues including hiring, termination, strategic restructuring and layoffs, disciplinary issues, medical leaves and general employment policies and procedures.
Representative matters and accomplishments include:
- Achieved summary judgment in California state court on behalf of a national manufacturing company against a plaintiff's claim of disability discrimination, denial of a reasonable accommodation and violations of the California Family Rights Act
- Achieved dismissal of investigations brought by California's Department of Fair Employment and Housing and Department of Labor Standards and Enforcement
- Successfully represented clients in mediations and settlement negotiations in both single plaintiff and class action lawsuits
- Convinced plaintiffs to submit to binding arbitration where there was no arbitration agreement between the parties.
Prior to joining Morgan Lewis, Mr. Kundu worked for a national Labor and Employment law firm in Orange County, California.
Mr. Kundu received his J.D. from the University of Southern California, Gould School of Law in 2007, where he was a member of the Hale Moot Court Honors Program and participated in the Gould School of Law Mediation Clinic, where he served as a mediator with Los Angeles County Superior Courts. Prior to attending law school, Mr. Kundu worked for five years as a business consultant for an international consulting firm. He received his B.A., with high honors, in economics and applied mathematics from the University of California, Berkeley in 1999.
Mr. Kundu is admitted to practice in California and before the U.S. Court of Appeals for the Ninth Circuit and the U.S. District Court for the Central District of California.
