Rebecca J. Hillyer is an associate in Morgan Lewis's Litigation Practice and a member of the Commercial Litigation Steering Committee. Ms. Hillyer concentrates her practice in commercial litigation, focusing on complex business fraud, business competition, trade secrets and intellectual property, mergers and acquisitions, product liability, and securities matters. She has represented clients in the medical device, pharmaceutical, healthcare, technology, and financial industries.
Ms. Hillyer received her J.D. from the University of Pennsylvania Law School in 2003, where she was comment editor of the Journal of Labor and Employment Law and a legal writing instructor. She received her B.A., with high distinction and high honors, in psychology from the University of Michigan in 2000, where she graduated Phi Beta Kappa.
Ms. Hillyer is admitted to practice in Pennsylvania and before the U.S. District Courts for the Eastern and Western Districts of Pennsylvania, the U.S. District Court for the Eastern District of Michigan, and the U.S. Court of Appeals for the Third Circuit.
Selected Representations
- Defended a global orthopedic implant manufacturer against claims of unfair competition, misappropriation of trade secrets, and tortious interference in Delaware state court asserted by an industry competitor, ultimately resulting in a favorable settlement.
- Defended a global player in the consumer money transfer services industry against breach of contract claim; after aggressively pursuing counterclaims such as fraud and misappropriation of trade secrets and proceeding through discovery, obtained favorable settlement.
- Defended an international heavy equipment manufacturer in Pennsylvania state court against product liability claims relating to an accident involving the client's industrial machinery, culminating in dismissal of all claims following plaintiff's case-in-chief at trial.
- Defended a global financial services firm against civil RICO claims relating to alleged mortgage fraud in Pennsylvania federal court; following oral argument on the motion to dismiss, the court dismissed all claims against the client.
- Currently representing a global pharmaceutical company in various cases filed by state Attorneys General pursuant to state unfair trade practices acts.
- Currently defending a global spinal implant manufacturer against claims by competitor involving allegations of unfair competition, misappropriation of trade secrets, and tortious interference, pending in federal court in New Jersey.
- Currently representing a global specialty chemicals company in pursuit of claims involving unfair competition, misappropriation of trade secrets, and tortious interference, pending in South Carolina state court.
- Currently representing the owner of a chain of restaurants and bars in post-acquisition dispute, pending in federal court in New York.
