Lisa Tenorio-Kutzkey is a partner-elect in Morgan Lewis's Litigation Practice. Ms. Tenorio-Kutzkey focuses her practice on the representation of corporations in civil and criminal antitrust litigation and the defense of individuals and companies in all phases of government investigation and prosecution.

Since joining Morgan Lewis in 2004, Ms. Tenorio-Kutzkey's practice has centered on conducting large-scale internal investigations and defending actions before the SEC, the U.S. Attorneys' Offices, the U.S. Department of Justice, and other government agencies.

Recent representations include:

  • Representation of an Asian technology company in its civil litigation and internal investigation related to a U.S. Department of Justice, Antitrust Division price-fixing investigation of the TFT-LCD and related industries
  • Representation of an Asian airline carrier in its global internal investigation, civil litigation, and related criminal prosecution by the U.S. Department of Justice, Antitrust Division in the air cargo and passenger services industries
  • Representation of a Fortune 100 company in its internal investigation of its foreign labor practices and related class action litigation
  • Representation of a Fortune 100 Silicon Valley technology company on an on-going basis in connection with subpoenas issued and investigations conducted by various law enforcement agencies
  • Representation of a Fortune 100 Silicon Valley technology company in an internal investigation related to the U.S. Department of Justice, Antitrust Division investigation of the E-Rate Program
  • Representation of a Fortune 200 company in a Foreign Corrupt Practices Act (FCPA) investigation in connection with investigations by the DOJ and the SEC
  • Representation of a Fortune 200 company in its internal investigation of certain stock option practices in connection with SEC and U.S. Attorney's Office inquiries
  • Representation of a Fortune 200 company in an internal investigation of allegations related to corporate tax payments in connection with investigations by the IRS and U.S. Attorney's Office
  • Representation of a leading marketer of apparel and soft goods in an Audit Committee investigation of allegations of bribery and kick-backs
  • Representation of a major financial services institution in connection with NASD inquiries of alleged shelf space and directed brokerage programs
  • Representation of a Texas technology company in its internal investigation of improper revenue recognition practices related to a SEC inquiry
  • Representation of a California medical device company in its internal investigation of off-label marketing and grand jury investigation by the U.S. Attorney's Office and FDA

Ms. Tenorio-Kutzkey also has represented individuals and executives in a variety of matters, including:

  • Representation of individuals in connection with the U.S. Department of Justice, Antitrust Division's SRAM investigation
  • Representation of various individual public company officers in connection with stock option backdating investigations being conducted by the U.S. Attorney's Office and SEC and related shareholder derivative litigation
  • Representation of multiple employees in an investigation by OFHEO of certain financial and accounting practices
  • Representation of an individual being prosecuted by the U.S. Attorney's Office for alleged financial manipulation

Prior to joining Morgan Lewis, Ms. Tenorio-Kutzkey served as a trial attorney with the U.S. Department of Justice, Antitrust Division in its San Francisco Field Office. While working at the Division, she conducted grand jury investigations involving international and domestic price fixing, output restriction, and sales allocation conspiracies. She also was involved in regulatory reviews of Silicon Valley mergers and acquisitions under the Hart-Scott-Rodino Act.

During her tenure with the U.S. Department of Justice, Ms. Tenorio-Kutzkey spent two years as a Special Assistant U.S. Attorney in the Securities Fraud Section of the U.S. Attorney's Office for the Northern District of California. She was appointed to the California Energy Market Manipulation Task Force, an elite group of prosecutors and FBI agents charged with investigating criminal activity in connection with the California energy crisis.

Ms. Tenorio-Kutzkey was named one of the "Top 15 Under 30" by San Francisco Chronicle Magazine. She has been profiled in various articles regarding her involvement in the California energy crisis investigation and has received commendations from the FBI, the U.S. Department of Treasury, and the U.S. Department of Justice.

Ms. Tenorio-Kutzkey earned her J.D. from the University of California, Berkeley Boalt Hall School of Law in 1999. She earned her B.A. in economics from Stanford University in 1996.

Ms. Tenorio-Kutzkey is admitted to practice in California.
