Karol Lyn Newman is a partner in Morgan Lewis's Energy Practice. Ms. Newman has worked in the energy area for 30 years, counseling major energy companies on regulatory compliance, advising on market investigations, and representing natural gas producers, marketers, local distribution companies, and end-users in FERC regulatory proceedings (both litigation and ADR). Ms. Newman is also a seasoned appellate lawyer, having argued numerous cases in the U.S. Courts of Appeals. Ms. Newman regularly advises clients on regulatory issues affecting proposed energy projects and has assisted clients in the negotiation of commercial agreements related to coal gasification, liquefied natural gas (LNG), natural gas storage, and natural gas transportation projects.
Recognized as a leading natural gas lawyer in the 2004 through 2009 editions of Chambers USA: America’s Leading Lawyers for Business, the 2006 and 2007 editions of Chambers Global: The World’s Leading Lawyers, and the 2006 through 2009 editions of The Best Lawyers in America, Ms. Newman also provides regulatory advice and counsel on oil pipeline rate and tariff issues and represents clients in FERC proceedings (both litigation and ADR) concerning regulated oil pipelines. Ms. Newman also assists clients on energy-related matters before the Department of the Interior, the Department of Energy, the Environmental Protection Agency, and the U.S. Congress.
Some of the more significant issues that Ms. Newman has addressed over the years involve federal jurisdiction, statutory interpretation, preemption, eminent domain, regulatory takings, the constitutionality of federal legislation, the consistency of agency action with federal legislation, affiliate transactions, ratemaking, capacity allocations, contracting, acquisitions, divestitures, reorganizations, recovery of stranded investment, unbundling, and environmental concerns.
Ms. Newman is admitted to practice in the District of Columbia and Maryland and before the U.S. Supreme Court; the U.S. Courts of Appeals for the Third, Fourth, Fifth, Tenth, Eleventh, and District of Columbia Circuits; the U.S. Court of Federal Claims; the U.S. District Court for the District of Columbia; and the Maryland Court of Appeals.
