Charles C. Jackson is a partner in Morgan Lewis's Labor and Employment Practice. Mr. Jackson is co-chair of the LEPG's Employee Benefits Litigation Practice Group and a member of the firm's Advisory Board.
Mr. Jackson represents employers in complex labor, employment and employee benefits (ERISA) litigation, particularly class and collective actions. He has extensive trial experience, having tried numerous jury and other cases to verdict. He also has substantial experience with appellate matters and has handled dozens of cases before federal and state appellate courts and has served as counsel in significant labor, employment, and ERISA cases before the U.S. Supreme Court.
Mr. Jackson served as lead counsel in Hecker v. Deere, the precedent-setting ERISA fiduciary breach/§ 404(c) safe harbor case in which the Seventh Circuit rejected class action claims that excessive fees were charged participants on retirement plan investments. He was lead trial counsel in the successful defenses of the first two post-Enron ERISA class action employer stock cases to go to trial, DiFelice v. US Airways and Brieger v. Tellabs. He was lead counsel in Quan v. Computer Sciences Corporation, in which the Ninth Circuit adopted the Moench presumption of prudence in employer stock cases. He also was co-lead counsel in the successful Brubaker v. Deere trial—an ERISA retiree medical benefits class action that sought to reverse a host of progressive changes to retiree medical benefits plans.
Mr. Jackson is currently chair of the board of directors of Cabrini Green Legal Aid, which provides legal services to Chicago's poorest citizens. He has served CGLA in various capacities throughout his legal career. He has had a variety of significant pro bono representations.
Mr. Jackson is admitted to practice in Illinois and before the U.S. Supreme Court and the U.S. Courts of Appeals for the District of Columbia, Second, Fourth, Sixth, Seventh, Eighth, Ninth, Tenth, and Eleventh Circuits.
Mr. Jackson is a fellow of The College of Labor & Employment Lawyers.
