Neal A. Fisher Jr. is an associate in Morgan Lewis's Labor and Employment Practice. Mr. Fisher's practice focuses on defending employers in wrongful termination, discrimination, harassment, and wage and hour single plaintiff and class action lawsuits under federal and California laws. He handles matters involving the California Fair Employment and Housing Act, the Fair Labor Standards Act (FLSA), the Family Medical LeaveAct (FMLA), the California Family Rights Act, and other labor and employment laws.

Mr. Fisher has represented clients and appeared before governmental agencies such as the Department of Fair Employment and Housing and the Department of Labor Standards Enforcement, in addition to state courts. He also counsels employers on a variety of employment related issues, including hiring, termination, strategic restructuring and layoffs, disciplinary issues, medical leaves, and general employment policies and procedures.

Mr. Fisher's representative matters and accomplishments include:

  • Achieved dismissal of investigations brought by California's Department of Fair Employment and Housing and Department of Labor Standards and Enforcement.
  • Successfully argued motions to compel matters into arbitration where the subject arbitration agreements were not entirely in accordance with state law.
  • Successfully represented clients in settlement negotiations in single plaintiff lawsuits.
  • Authored successful briefs on behalf of a national bottling company where the National Labor Relations Board had initiated investigations of alleged unfair labor practices.

Prior to joining Morgan Lewis, Mr. Fisher worked for a national labor and employment law firm in Orange County, California.

Mr. Fisher received his J.D. from Georgetown University Law Center in 2009. During law school, he taught at a local high school as part of Georgetown Law Center's Street Law Clinic, served as an editor on the Journal of Poverty Law and Policy, and clerked at a major international law firm, where he assisted with several labor and employment matters. Mr. Fisher earned his B.A., magna cum laude, from Georgetown University in 2006.
