Seth M. Kaplan is an associate in Morgan Lewis's Labor and Employment Practice. Mr. Kaplan represents clients in a wide variety of complex employment litigation matters, including nationwide class and collective actions regarding wage and hour issues under federal and state law; single and multi-plaintiff matters involving federal, state, and local employment discrimination statutes and regulations (including Title VII, ADA, ADEA, FMLA, and WARN); noncompetition/nonsolicitation issues; breach of contract claims; and employment-related tort claims. Mr. Kaplan also represents clients at arbitration hearings before the AAA, the NASD, and the NYSE.

In addition to his litigation practice, Mr. Kaplan regularly advises clients regarding their compliance with these employment-related statutes, regulations and laws, and preventative measures that limit future liability. He regularly conducts internal audits for wage and hour matters, presents training sessions regarding workforce discrimination and harassment prevention, and provides counseling on various day-to-day human resources matters, including the handling of disciplinary and termination issues and the drafting and administration of employment agreements, separation agreements, and employment-related policies.

Mr. Kaplan also provides advice on labor and employment matters arising out of clients' corporate transactions, reorganizations, and reductions in force. In addition, he represents clients in traditional labor law matters that involve the National Labor Relations Act, including advising clients during union-organizing campaigns, representing clients in representation and unfair labor practice charge proceedings before the National Labor Relations Board, and representing clients in arbitrations that are initiated pursuant to collective bargaining agreements.

Mr. Kaplan is admitted to practice in New York and New Jersey and before the U.S. District Courts for the Southern and Eastern Districts of New York and the U.S. District Court for the District of New Jersey.
