Coleen M. Meehan is a partner and trial lawyer in Morgan Lewis's Litigation Practice, resident in the Philadelphia office. Ms. Meehan’s practice encompasses a variety of commercial and civil litigation, with particular emphasis on handling complex commercial litigation and business tort matters.
Ms. Meehan has represented companies in numerous industries, including publishing, manufacturing, consumer products, financial institutions, insurance, pharmaceutical, and healthcare. She has litigated cases before state and federal courts at both the trial and appellate levels, the American Arbitration Association, the Trademark Trial and Appeal Board of the U.S. Patent and Trademark Office, and the National Advertising Division of the Council of Better Business Bureaus. Some representative examples of matters that she has handled include:
- Co-lead counsel to a licensee of an internationally known trademark in the prosecution of claims against the licensor for breach of the terms of the license agreement, breach of fiduciary duty, and breach of the covenant of good faith and fair dealing. Following conclusion of liability phase of mandatory arbitration which resulted in a multimillion dollar award for Ms. Meehan’s client, Ms. Meehan negotiated a complex settlement for her client that included cash payments and favorable prospective licensing rights.
- Lead counsel to the U.S. subsidiary of an international bank in the prosecution of injunctive claims against a departing executive alleged to have stolen trade secrets, breached noncompete provisions, and breached confidentiality obligations. After successfully obtaining injunctive relief for her client, Ms. Meehan obtained a permanent injunction, which, among other things, precluded the defendant from working for a new employer and competing against her client.
- Lead counsel to one of the largest insurance and financial services company in the world in the prosecution of trademark infringement claims arising out of the defendants’ grey market sales of insurance policies purportedly issued by Ms. Meehan’s client. After successfully obtaining injunctive relief and a sanctions order for her client arising out of the defendants’ destruction of documents, Ms. Meehan obtained a permanent injunction.
- Lead counsel to a healthcare insurer in the defense of a multimillion dollar breach of contract action involving a dispute over reimbursement provisions of a multiyear contract. Ms. Meehan obtained a complete defense verdict for her client.
- Lead counsel to a leading manufacturing company in the defense of a breach of contract and business fraud action involving a dispute over the termination of a distribution agreement. After obtaining summary judgment for her client on the contract claims, Ms. Meehan negotiated a favorable settlement for her client.
- Lead counsel to a leading medical device manufacturer in the defense of a breach of contract and business fraud action involving a dispute over the termination of a distribution agreement. After successfully filing a Rule 12 motion challenging court’s subject matter jurisdiction, Ms. Meehan negotiated a favorable settlement for her client.
- Lead counsel to a healthcare insurer in the defense of a multimillion dollar breach of contract action involving a dispute over application of Medicare’s recapture of depreciation. Ms. Meehan obtained a complete defense verdict for her client.
- Co-lead counsel to a healthcare insurer in the defense of a class action asserting, inter alia, antitrust claims arising out of the client’s use of a “most favored nations” provision. After successfully defeating the plaintiffs’ motion for class certification, she obtained successful settlement for her client that involved no payments or prospective changes to her client’s business strategy.
In addition to her litigation practice, Ms. Meehan counsels clients in intellectual property matters, including false advertising, trademarks, trade secrets, licensing, and unfair competition. She also regularly counsels clients and colleagues on e-discovery and the retention and discovery of information stored electronically. Active in firm management, Ms. Meehan is a chair emeritus of the Philadelphia Office’s Professional Recruiting Committee and currently serves as the administrative and assigning partner for the Philadelphia Litigation Practice.
Ms. Meehan runs the Philadelphia Office’s pro bono program with the Delaware County District Attorney’s Office, pursuant to which the firm’s attorneys represent the Commonwealth of Pennsylvania in prosecuting alleged criminals at preliminary hearings. She also serves as a volunteer attorney for the Support Center for Child Advocates, representing abused and neglected children, and serves as an adjunct professor of law at Villanova University School of Law, where she teaches Civil Pretrial Practice to third-year law students. Active in community affairs, Ms. Meehan recently served as a member of the board of directors of United Way of Southeastern Pennsylvania and Catholic Social Services. Ms. Meehan is admitted to practice in Pennsylvania and New Jersey.
