Department of Homeland Security Expansive Chemical Facility Reporting Requirements Due Tuesday

On November 2, 2007, the Department of Homeland Security (DHS) released Appendix A of the Chemical Facility Anti-Terrorism Standards (Appendix A). Appendix A is the final part of the March 2007 comprehensive federal security regulations aimed at identifying “high risk” chemical facilities across the country.

Most importantly, the regulations are not limited to traditional chemical facilities. Rather, as part of the new regulations, any facility that “possess or plans to possess, at any relevant time” any Appendix A chemical above a specified quantity must complete and submit, by January 22, 2008, a “Top-Screen” online assessment available from DHS’s website. The Top-Screen online assessment asks about the type and quantity of each chemical of interest at the facility site, including locations of chemical storage, topography of the facility, and maximum production capacity.
