Brett P. Ferenchak assists common and private wireline, wireless and satellite carriers, Internet and technology companies, and non-communications companies with various telecommunications-related regulatory issues. He advises communications companies, investors and lenders on regulatory aspects of mergers, acquisitions, and other corporate transactions, as well as financing and debt arrangements.  Brett also provides advice on privacy and telemarketing issues to a wide range of companies.

Brett assists new carriers in navigating the complex regulatory entry requirements, including certification, tariff, franchise and right-of-way issues, and post-entry compliance issues, such as periodic reporting, fees, and assessments. He also advises on regulatory issues affecting clients entering and emerging from bankruptcy. Brett advises vendors and customers on service, equipment, and licensing agreements. He also helps telecommunications clients navigate the Team Telecom process associated with foreign ownership. Brett additionally counsels in complaint and other adversarial proceedings, including enforcement actions, before the Federal Communications Commission and state regulatory agencies.

Brett authored the article “Regulating Indecent Broadcasting: Setting Sail From Safe Harbors or Sunk by the V-Chip?” for the University of Richmond Law Review.
