Daniel R. Salemi counsels clients on the full range of issues related to retirement plans, health and welfare plans, plan investments (under ERISA and individual US state laws), and deferred and equity-based compensation arrangements, helping them design and maintain state-of-the-art benefit plans to achieve unique operational goals. Dan’s broad experience in the employee benefits area includes the representation of clients in collective bargaining, litigation, and mergers and acquisitions.
Dan also represents employers with respect to multiemployer pension withdrawal liability issues in a variety of contexts, including litigation, collective bargaining, workforce restructuring, subcontracting, corporate transactions, and plant relocations and closures. He has worked with employers on withdrawal liability issues in a wide variety of industries, including transportation, construction, food, baking, manufacturing, hospitality, textiles, and entertainment.
Dan represents employers and plan sponsors across the United States in various sectors, including private, public, and nonprofit companies and organizations. He also represents employer associations, multiemployer funds, and public benefit plans, and his experience includes advising on the unique benefits and labor law issues these types of clients face.
Dan helps employers develop and negotiate the benefits and compensation provisions in employment agreements with key employees and executives, and aims to provide in-depth, practical counseling on initial plan design, day-to-day plan administration and compliance, plan funding, and plan modification and termination.
Dan frequently speaks on employee benefit plan compliance issues and has presented to the International Foundation of Employee Benefit Plans, the Worldwide Employee Benefits Network, the American Bar Association, the National Association of College and University Attorneys, and the Illinois Association of School Boards, among others.
Additionally, Dan has authored articles published in Benefits Magazine, Bloomberg BNA, Benefits & Compensation Digest, NACUANOTES, Employee Benefit Plan Review, and The Corporate Executive.
Represents large employers and health and welfare benefit plans in the public and private sectors on compliance with all applicable federal and state laws, including the Affordable Care Act, HIPAA, COBRA, the Internal Revenue Code, and ERISA
Represents large employers and multiemployer pension and retirement plans with the design, funding, ongoing administration, and termination of retirement plans of all types (including defined benefit pension, cash balance, profit sharing, 403(b), 401(k), and 457 plans)
Represents employers and multiemployer plans in the private and public sectors on the design and funding of retiree health arrangements
Represents employers, multiemployer plans, and other plan sponsors in plan correction matters, plan audits, and other issues involving the US Department of Labor, the Internal Revenue Service, and the Pension Benefit Guaranty Corporation
