Alejandro David Szwarcsztejn is a trial attorney whose practice is focused on complex employment litigation. David regularly represents employers in the financial services, retail, technology, and automotive industries in wage and hour class actions as well as harassment, discrimination, retaliation, unfair competition, and whistleblowing claims in federal and state court. He also partners with clients to develop effective, legally-compliant solutions to address a wide variety of employment law issues in the workplace.
Extended Profile
David’s trial experience includes bench and jury trials resulting in complete defense judgments in a wage and hour class action, a multimillion dollar corporate raiding lawsuit, and single-plaintiff wrongful termination and unpaid wages actions. He has also obtained favorable outcomes in a variety of federal and state agency proceedings, including before the US Department of Labor, California Labor Commissioner, California Department of Fair Employment and Housing, and California Workers’ Compensation Appeals Board.
David works closely with clients to proactively mitigate the risk of potential litigation by auditing wage and hour practices, investigating sensitive workplace complaints, presenting sexual harassment training for supervisors and employees, and revising workplace policies.
