Doug D. Orvis counsels clients on telecommunications regulatory compliance, with particular emphasis on the federal Universal Service Fund (USF). He routinely aids telecommunications carriers in complying with ongoing reporting and contribution obligations, including guidance on procedures to minimize USF liability. Doug also actively practices before the FCC’s Enforcement Bureau, defending investigations related to USF, data privacy, mobile cramming, and other consumer-related issues.
Doug advises startup companies in meeting their initial USF obligations, and he helps well-established carriers in their ongoing USF procedures, including receiving funds from the Low Income and Schools and Libraries Programs of the Fund. Doug’s work includes successful appeals of contrary rulings by the USF administrator at the Federal Communications Commission. He also defends carriers in audits by the USF administrator, including defending of carriers with hundreds of millions of dollars of potential USF contribution liability. Doug additionally practices before the FCC’s Enforcement Bureau. He defends numerous carriers in investigations, including negotiation settlements and consent decrees, and he has successfully avoided the imposition of significant forfeiture penalties, particularly those who have been accused of USF or Truth-in-Billing violations.
Doug also advises clients in telecommunications-focused commercial matters, such as commercial contracts (including managed services, Value Added Networks, Virtual Private Networks, fiber and equipment sales and leasing, and software as a service), acquisitions (including stock and asset transactions), and related taxation of telecommunications.
In addition, Doug practices before state Public Service Commissions, most notably the California Public Utilities Commission, assisting companies with a variety of California-related telecommunications regulatory matters.
