Donna Lee Yesner represents clients in the life sciences in transactions, disputes, regulatory compliance, and strategic business planning relating to public healthcare programs and government contracts. Frequently representing pharmaceutical, biological, and medical device companies, Donna advises on US Federal Supply Schedule contracting, pharmaceutical research, and development agreements, and matters involving suspension, debarment, and exclusion from federal programs. She also counsels companies on federal healthcare program reimbursement, drug price reporting, and compliance requirements, and their potential business impact on the companies.
Donna advises clients on issues involving the acquisition and reimbursement of US federal healthcare supplies and services, particularly contracts and agreements involving the US Department of Veterans Affairs (VA), the US Department of Defense (DOD), and the US Department of Health and Human Services (HHS). She also counsels on compliance issues relating to Medicaid, Medicare, Tricare, the Vaccines for Children program, and the 340B drug discount program; public policy affecting these programs; and healthcare fraud.
Additionally, Donna has represented clients in litigation and alternative dispute resolution matters before US District Courts and Courts of Appeals, boards of contract appeals, and before the US Court of Federal Claims.
Donna serves as vice-chair of the ABA Public Contracts Section Health Care Contracting Committee, and co-chair of the Coalition for Government Procurement Health Care Committee. She also publishes and lectures frequently on procurement, pricing, and reimbursement of medical supplies. She received recognition as an LMG Life Sciences Star from 2012 to 2017.
Prior to becoming senior counsel, Donna was a partner in the firm’s FDA practice and before joining Morgan Lewis, she was a partner in the Washington, DC office of another international law firm.
