Elizabeth A. Erskine leads a team that coordinates local litigation counsel across the United States for major bank corporate trustees. Her particular focus is litigation related to the subprime mortgage crisis. Clients facing claims involving loans in residential mortgage-backed securitization trusts brought by consumer borrowers, investors, and governmental agencies turn to her for defense and nationwide management of such claims. Elizabeth also provides trust administration and risk management advice to corporate trustee clients.
Elizabeth works with local counsel to prepare trustee clients for deposition and trial, and she assists those clients with preparation of affidavits and discovery responses for use in cases nationwide. In addition to her work with clients in the banking industry, Elizabeth has experience litigating complex civil actions, such as nationwide pharmaceutical class actions, insurance bad faith, breach of fiduciary duty, errors and omissions, and aviation products liability cases. She partners with clients from the pleading stage, law and motion, discovery, trial preparation, and through trial. In a US federal court case, she obtained a seven–figure jury verdict that was upheld on appeal.
As a former vice president and senior counsel for one of the largest banks in the United States, Elizabeth supervised litigation involving the bank in its capacity as trustee. She also worked as senior counsel for a national law firm serving as national coordinating defense counsel in pharmaceutical class actions, and as a partner at a large California trial firm, Elizabeth represented clients across a wide range of matters.
