Hillary E. August litigates and counsels employers in a range of industries. Her practice focuses on defending employers in complex class actions and single-plaintiff claims under the Employee Retirement Income Security Act (ERISA). She regularly represents plans, plan sponsors, plan fiduciaries, investment consultants, and plan recordkeepers in suits arising from claims related to the management and administration of qualified and nonqualified retirement plans, in addition to health and welfare plans. Hillary also advises clients in preparing benefits policies and mitigating litigation risk.
Additionally, Hillary has broad defense experience in areas such as healthcare litigation, breach of contract and breach of fiduciary duty claims, patent litigation, antitrust suits, and consumer class actions.
Hillary is a regular presenter on ERISA topics at Continuing Legal Education programs. She is also on the editorial board of and is a regular contributor to Bender’s California Labor & Employment Law Bulletin. In addition, Hillary has an active pro bono practice. She successfully pursued and settled several civil rights suits in federal court. In 2016, she was awarded the Excellence in Pro Bono Service Award from the Northern District of Illinois and Federal Bar Association. Hillary also advises not-for-profit entities on their employee handbooks on a pro bono basis.
Prior to joining Morgan Lewis, Hillary served as judicial clerk to Judge Joan Humphrey Lefkow of the US District Court for the Northern District of Illinois, and was an associate in the litigation department of a prestigious Chicago-based firm. While in law school, she served as topic access and recruitment editor for Volume 79 of The University of Chicago Law Review, was elected to the Order of the Coif, and was named a Kirkland and Ellis Scholar. Hillary is fluent in French.
