Jeffrey A. Sturgeon litigates employment, whistleblower, benefits, securities, commercial, and fiduciary liability issues in state and federal courts throughout the United States. He represents some of the Firm’s biggest clients in single-plaintiff, multi-plaintiff, and complex collective and class action litigation, securing several notable victories in courts, arbitration tribunals, and before government agencies.
Jeff’s significant trial experience spans more than a decade. He frequently represents companies in the insurance, financial services, technology, and food industry. He also represents service professionals. Those cases often involve requests for injunctive relief. By way of illustration, during a three-year period, Jeff helped defeat repeated requests for emergency relief by the terminated CEO of a technology company, a case that was hotly litigated for almost a year. He also served as counsel for an insurance company in a discrimination matter by a former executive, a financial services company in a defamation and wrongful termination matter by a former broker seeking $30 Million in damages, and a group of medical professionals in a wrongful termination matter that was brought by their former CEO and President. All three arbitrations lasted several weeks and resulted in complete victories, with an affirmative finding that the CEO and President of the medical professionals’ group breached his fiduciary duty of loyalty.
Jeff also served as counsel for a Fortune 500 company in an ERISA class action involving thousands of participants in the company’s 401k plan. The class asserted breach of fiduciary duty and prohibited transaction claims. After a four-week trial in federal court, during which Jeff cross-examined one of the lead plaintiffs, the court awarded a fraction of the $600 Million damages that were sought. That award was later reduced to zero after appeal. Jeff’s experience also includes the representation of a Big Four accounting firm in a nationwide securities fraud class action, and a large insurance company accused of civil RICO violations by a class that consisted of several thousand physicians.
