Kevin Gaffney litigates before United States federal and state trial courts in actions involving US federal, state, and local employment laws. A pillar of his practice is defending employers in high-stakes class and collective wage-and-hour actions, including misclassification and off-the-clock claims arising under the Fair Labor Standards Act (FLSA) and related state statutes. Another pillar of Kevin’s practice is defending employers and fiduciaries in class actions arising under the Employee Retirement Income Security Act (ERISA).

Additionally, he routinely defends employers in single-plaintiff actions arising under ERISA, FLSA, Family Medical Leave Act (FMLA), Americans with Disabilities Act (ADA), Title VII, Age Discrimination in Employment Act (ADEA), state and federal whistleblower-protection laws (including the Sarbanes Oxley-Act (SOX)), as well as other statutory and common law theories. 

In addition to employment litigation, Kevin maintains an active pro bono practice and serves as the Associate Chair of Morgan Lewis’s Chicago office Pro Bono Committee. He counsels non-profit organizations on employment issues and represents clients as part of the National Immigrant Justice Center’s Deferred Action for Childhood Arrivals (DACA) clinic. 

Kevin is an editor of BNA’s Age Discrimination in Employment treatise and a member of Morgan Lewis’s Chicago office Hiring Committee.

During law school at the Northwestern Pritzker School of Law, Kevin was an editor for the Journal of Law & Social Policy and served as a teaching assistant for Communications and Legal Research.
