Mario Milano advises clients in all aspects of intellectual property primarily in design and utility patent prosecution, due diligence and clearance, and licensing. Mario counsels clients in a wide range of technological fields including drug delivery, biomedical device, electromechanical, aerospace, construction equipment, food and beverage, and automotive industries. His clients range from early stage startups to Fortune 100 companies.
Mario’s work with clients in the drug delivery space has produced numerous patents that are listed in the FDA orange book. He is well-versed in efficiently navigating the patent process by working with examiners to move applications to allowance while protecting inventions from multiple angles.
Mario counsels clients in the acquisition or development of new technologies and product lines to ensure maximum protection, while gauging risk with respect to the intellectual property rights of others. He is Black Duck certified to help clients gauge any risks associated with software due diligence projects. He has considerable experience conducting patentability studies, providing clients an early understanding of the scope and availability of patent protection for their inventions. These studies go hand in glove with freedom-to-operate opinions in which he advises clients regarding their right to use developed technology. Mario also works with clients to develop strategy for patent challenges including reexaminations and inter partes reviews.
