For more than 33 years, Peter R. Batten has represented and advised sophisticated owners, developers, investors, lenders, tenants and other end-users, and high net worth families and individuals in an extremely diverse and dynamic blend of complex real estate transactions encompassing all phases of real estate acquisition, development, financing, restructuring, leasing and disposition, real estate joint ventures and investments and the real estate side of merger, acquisition and other corporate transactions, project finance and industrial development agency transactions.

As a seasoned transactional lawyer with a broad range of experience, Peter’s background spans all asset and project types in markets across the United States, including raw land, high end residential, multifamily, office, industrial, retail, hotel, airport, seaport, intermodal transportation, and other single-and mixed-use properties, as well as natural gas and wind, solar, and hydro generation projects.

With experience on all sides of the transaction table, Peter brings a practical, balanced, and business-oriented approach to his practice. He is dedicated to providing superlative service and results-focused legal representation in order to achieve his clients’ goals.

Peter also volunteers his time presenting workshops on commercial leases to small business owners and aspiring entrepreneurs throughout New York City.

Recent projects Peter has played a direct role in as real estate counsel include:

  • Acquisition by Hitachi Metals Ltd. for $1.3 billion of Waupaca Foundry Inc. and its six foundries and three landfills in the United States
  • Acquisition by Kuraray Co., Ltd. for $543 million of DuPont’s glass laminating solutions/vinyls business including the acquisition and ground leasing of six manufacturing sites in the United States, Europe and Asia
  • Acquisition by Freeman Spogli & Co. and Investcorp of totes Isotoner Holdings Corp.
  • Disposition by Nippon Paint (USA) Inc. of its Seibert Powder Coatings division
  • $228 million project financing of a greenfield development and construction of a recycled linerboard mill in Niagara Falls, N.Y.
  • All leasing and financing matters for a 500,000-square-foot office and retail building in Midtown South Manhattan
  • Advised a New York City developer in its joint ventures with equity investors for the acquisition and financing of various condominium construction projects
  • Advised a Dutch pension fund in connection with its United States investment funds and joint ventures
  • The development, tax equity investment and financing of wind farm projects across the United States including the 845 MW Shepherds Flat project in Oregon, the 662.5-MW Capricorn Ridge project in west Texas, the 285 MW Noble and 334.5 MW Noble II projects in New York, the 110 MW Gratiot project in Michigan, a 183 MW, 11-project portfolio in Idaho, a 91 MW, two phase project in Colorado, the 130.5 MW Benton County project in Indiana and a 300 MW project in Oklahoma
  • $41 million tax equity financing of a portfolio of five solar power generation plants located at sites in California, with offtakers Hewlett-Packard Company, the county of Lake and the Lake County Sanitation District, Toyota Motor Sales U.S.A. and Agilent Technologies Inc.
  • $155 million loan guarantee by the Department of Energy for the development and construction of a 30 MW solar photovoltaic facility

Presented a workshop on Understanding Commercial Leases to more than 50 small business owners and hopeful entrepreneurs. The workshop was coordinated by two nonprofits, the Bronx-based Start Small, Think Big and the Brooklyn-based Business Outreach Center's Women's Center (July 2014).
