Peter C. Neger

Currently, among other matters, Peter represents a financial technology company in actions brought by the company’s former CEO in multiple state and federal courts arising out of the former officer’s claim to control a majority of the company’s shares; owners of a large affordable housing project located in Brooklyn, N.Y., in federal and state court litigation challenging rent increase orders issued by government authorities; a financial institution alleged to have breached its fiduciary duties as corporate trustee of a revocable trust; and a bioresearch firm engaged in a dispute with a consultant arising out of the consultant’s claim to royalties under a license agreement. Peter is also pro bono counsel for a gay Jamaican man seeking asylum in the United States based upon his sexual orientation, and a Honduran teenager seeking Special Immigrant Juvenile Status in the United States.

Peter previously served as lead national counsel for a pharmaceutical manufacturer in the fen/phen diet drug litigation, involving more than 7,000 individual and class action lawsuits filed in a federal MDL and state courts throughout the United States. He was also the court-appointed defense liaison counsel in the Ephedra MDL and a member of the defendants’ coordinating counsel. Peter acted as national coordinating counsel for a manufacturer of generic methylphenidate and functioned in the same capacity in litigation involving claims that the use of a mercury-based preservative in childhood vaccines caused autism.

Peter has also represented clients in various types of real estate litigation, including partnership disputes and dissolutions, land use disputes and commercial landlord-tenant proceedings; securities fraud and class actions; civil RICO actions; foreclosure and other bank-related litigation; SEC enforcement proceedings; trademark infringement actions; and actions involving professional liability claims, sex and race discrimination claims, and alleged bankruptcy frauds.

• Represented the nonoperating leaseholders of the Macondo 252 well in an MDL in New Orleans, La., arising out of the Deepwater Horizon oil spill
• Represented a pharmaceutical manufacturer in a civil action arising out of a teenager’s murder of his parents, allegedly while under the influence of stimulant medication
• Obtained dismissal of a suit filed under the federal False Claims Act by a “whistleblower” who claimed that a Manhattan, N.Y., landlord submitted overstated claims to the US Department of Housing and Urban Development for Section 8 payments based on allegedly inflated rents charged to tenants
• Achieved a favorable settlement for a cable television provider in a putative class action involving the privacy of former subscribers’ personally identifiable information
• Represented a utility in a 180-day tax certiorari trial in which the utility was awarded a property tax refund in excess of $200 million
• Represented a Manhattan, N.Y., cooperative apartment building in a boundary dispute with the city of New York over ownership of a waterfront backyard garden
• Obtained dismissals on behalf of an arbitrage firm in an SEC enforcement proceeding and a related civil action arising out of a proxy contest for control of a cellular communications company
• Represented a Dutch pension fund in a dispute with the general partner of a partnership in which it invested over alleged breaches of the general partner’s fiduciary duty
• Represented financial services company in shareholder demand for access to books and records under N.Y. Bus. Corp. Law
• Defended a financial institution in a class action alleging wrongful calculation and collection of mortgage escrow funds
