Seth A. Rappaport concentrates his practice on intellectual property (IP) counseling, including prosecution and portfolio management involving trademarks and unfair competition. Seth counsels clients in a wide variety of industries on a range of prosecution and enforcement matters in the United States and globally. He also helps clients manage domestic and international trademark portfolios by providing guidance on trademark clearance, registration, and maintenance issues.
Seth routinely counsels clients on global brand protection, including initiating and defending trademark opposition and cancellation actions at the Trademark Trial and Appeal Board (TTAB) and domain name enforcement actions. He also counsels clients on trademark filing and protection strategies globally.
Seth previously spent 11 years at the US Patent and Trademark Office (USPTO) where he was an examining attorney and, later, a senior supervisory attorney in trademarks. In addition to his trademark prosecution and management duties at the USPTO, Seth also worked closely on issues surrounding the registrability of new gTLDs that were created as part of ICANN’s new gTLD program and issues surrounding varietal and cultivar names. During his time at the USPTO, Seth was recognized for outstanding performance by the USPTO and the American Intellectual Property Law Association.
