Beginning with US President Barack Obama’s call for new cybersecurity legislation in his State of the Union Address on January 20, cybersecurity has been at the forefront of the administration’s legislative priorities in 2015 as well as a strategic priority for federal law enforcement and an increasingly costly issue for private industry. In a recent article published in The National Law Journal, Morgan Lewis privacy and cybersecurity partner Mark Krotoski discusses five key issues to consider when confronting the rapidly evolving landscape of cybercrime and cybersecurity law. Among other topics of concern, Mr. Krotoski discusses the prospects for uniform data breach notification standards on a national level, the current state of federal computer crime law in federal courts, the current federal regime for trade secrets protection, recent legislative proposals to facilitate cyber threat information sharing, and the restoration of public trust in law enforcement related to cybersecurity issues.
