Evan K. Jacobs
Evan K. Jacobs is a versatile litigator who handles complex and bet-the-company multidistrict litigation, mass tort claims, state attorney general investigations, consumer protection, and unfair competition disputes. Evan has acted as national counsel managing all aspects of the defense in nationwide opioid litigation for a major pharmaceutical manufacturer, including coordinating multiple trial teams, defending novel public nuisance theories in state and federal court, and addressing complex discovery issues in multijurisdictional litigation with active cases throughout the United States.
Evan has experience in efficiently managing discovery across multiple jurisdictions and overseeing ediscovery; coordinating with plaintiff and defense steering committees; negotiating settlements with various stakeholders, including attorneys general and private contingency counsel; and implementing litigation strategy. Evan has counseled clients through all aspects of litigation, from prelitigation investigations and negotiations through trial and appeal.
While in law school, Evan served as a notes editor on the Georgetown Law Journal and competed as a member of the moot court team. At Penn State, Evan was the executive director for the Penn State Dance MaraTHON, the largest student-run philanthropy in the world, which has raised more than $147 million for children and their families battling childhood cancer.

- Represented a leading global health services company in a nationwide class action challenging pharmaceutical benefits practices under ERISA and RICO
- Represented one of the world’s leading food and beverage companies in the defense of breach of contract claims asserted in the US District Court for the District of New Jersey by the assignee for the benefit of creditors appointed to oversee the liquidation of the client’s former regional supplier of corrugated boxes, as well as in the defense of preference claims asserted by the assignee in New Jersey State court; both cases settled favorably on the eve of trial
- Represented a prominent national university in actions in the Eastern District of Pennsylvania and the Western District of Tennessee regarding alleged breaches of material transfer agreements and patent infringement relating to novel cancer treatment; both cases resolved favorably
- Represented one of the world’s leading food and beverage companies in the defense of a breach of contract action seeking in excess of $30 million of damages, and the prosecution of indemnity claims against third parties, in the US District Court for the Eastern District of Pennsylvania; obtained summary judgment dismissing the bulk of plaintiff’s case, after which the lawsuit favorably resolved
- Represented a leading orthopedic implant manufacturer in the US District Court for the District of New Jersey in the defense of equitable and legal claims of unfair competition and tortious interference asserted by an industry competitor, stemming from allegations of corporate raiding of sales representatives
