Gregory T. Fouts advises clients on complex litigation matters, largely focusing on consumer class action defense. Handling cases in federal and state courts across the United States, Greg primarily represents financial services firms, technology companies, retailers, and other consumer-facing clients in class actions that claim his clients have violated federal statutes, state consumer fraud and privacy statutes, breach of fiduciary duty, and breach of contract. Greg also has experience representing technology companies in class actions filed under the Illinois Biometric Information Privacy Act.
In addition to defending class action cases, Greg represents clients in investigations, enforcement actions, and litigation brought by regulators including the Consumer Financial Protection Bureau (CFPB), the Office of the Comptroller of the Currency (OCC), and state attorneys general.
Greg’s experience also includes representing clients in commercial disputes. He defends clients in accounting malpractice suits, as well as lender liability, breach of contract, and breach of fiduciary duty matters.
As part of his active pro bono practice, Greg was part of a team that secured a $1.8 million settlement on behalf of James Andrews, a victim of mistreatment by the Chicago Police Department. He also has represented clients in habeas corpus, immigration, and adoption proceedings.
