Jordan McCrary
Jordan McCrary handles high-stakes commercial litigation for both plaintiffs and defendants. His cases often arise from mergers, acquisitions, and partnership disputes. He prosecutes and defends claims involving breach of contract, fraud, breach of fiduciary duty, unfair competition, and other business torts. He also defends against consumer class actions. Jordan is a creative litigator, pragmatic problem-solver, and tenacious advocate with a track record of success. He has won at trial, via dispositive motions, and on appeal. For plaintiffs, he has secured hundreds of millions of dollars and injunctive relief. For defendants, Jordan has defeated class actions and “bet the company” litigation.
Jordan excels at understanding his clients’ business issues and crafting solutions to achieve their goals. Clients frequently turn to him to handle cases where companies, products, careers, and reputations are at stake. His clients include individuals and business organizations in many industries, including life sciences, healthcare, real estate, and technology. Jordan represents life sciences companies in disputes arising from product divestments, acquisitions, and licensing deals. He represents healthcare companies in litigation concerning provider agreements, reimbursement disputes, and government regulation. He also handles real estate litigation, including disputes from high-value deals gone sour, as well as fraudulent conveyance claims. Jordan also represents technology companies operating peer-to-peer online marketplaces in actions involving government regulations, catastrophic personal injuries, and consumer class actions.
Jordan maintains an active pro bono practice, providing free legal services to secure access to justice for those in need. In recognition of his life-changing advocacy for vulnerable members of society, Public Counsel honored him with the Pro Bono Award for Homelessness Prevention. His work also led to the Legal Aid Foundation of Los Angeles naming Morgan Lewis the Pro Bono Law Firm of the Year.
Jordan is a member of the Association of Business Trial Lawyers, and he previously served as co-chair and founding member of its Technology Committee. Jordan also served as an extern for Judge Dean D. Pregerson of the US District Court for the Central District of California.
- Represented the seller of a real estate business in international arbitration against the buyer, resulting in the client recovering $11.6 million and defeating $16 million in counterclaims
- Prosecuted a pharmaceutical royalty and licensing agreement dispute, resulting in the client recovering $26 million
- Obtained summary judgment for the client in a real estate contract dispute, resulting in a victory valued at more than $200 million
- Obtained dismissal on demurrer of claims by real estate investors for breach of fiduciary duty and fraud, resulting in the published California Court of Appeal opinion, WA Southwest 2, LLC v. First American Title Insurance Co., 240 Cal. App. 4th 148 (2015)
- Defeated class certification, effectively disposing of claims exceeding $16 million against the client arising from disputes concerning tenants’ security deposits
- Secured summary judgment on behalf of a retail goods manufacturer, resulting in the dismissal of a certified class action seeking damages exceeding $12 million based on alleged violations of the Telephone Consumer Protection Act (TCPA)
- Obtained dismissal of claims for breaches of representations and warranties in purchase agreement against clients who sold their business
- Achieved dismissal of claims against the managing member of an LLC by another member concerning management of the LLC and interpretation of the operating agreement
- Secured dismissal of claims for breach of contract, breach of fiduciary duty, and indemnity against the client arising from disputes concerning the client’s bylaws
- Obtained key international discovery under the Hague Convention from banks in Cypress and Latvia in support of a bank prosecuting case for fraudulent transfer of real property
- On behalf of a bank defending against claims by an account holder, secured court order eliminating $18 million in claims
- On behalf of 21 elderly and disabled pro bono clients, obtained an injunction prohibiting unlawful eviction and won a substantial monetary settlement
- On behalf of 18 Holocaust survivors facing homelessness when their below-market-rate tenancies were terminated, negotiated a settlement allowing these pro bono clients to remain in their homes without any rental increase for the remainder of their lives
