Website Tracking, Data Breaches, and AI Class Actions, Global Relay Intelligence & Practice

08. April 2026

Partners Megan Suehiro, Heather Egan, and Catherine North Hounfodji co-authored an article for Global Relay Intelligence & Practice examining the rise of privacy- and technology-driven class actions and the resulting litigation risks for companies using website tracking tools, managing data, or deploying artificial intelligence (AI) systems.

The authors analyze how plaintiffs are applying legacy wiretapping and consumer protection statutes to modern technologies, with courts increasingly allowing claims to proceed past the pleading stage, heightening settlement pressure. The article also emphasizes that governance, documentation, and cross-functional oversight are central to managing exposure, as routine digital practices and business decisions are now being scrutinized through class action frameworks.
