CONDUCTING AN INTERNAL FORM I-9 AUDIT
Understanding and Implementing the Latest US Government Guidance
US Citizenship and Immigration Services (USCIS) and the Department of Justice Special Counsel for Immigration-Related Unfair Employment Practices recently issued jointly prepared guidance to employers that conduct their own internal Form I‑9 audits. This is the first time that the two agencies have combined to offer guidance at this level, and it is expected that the agencies will take the position that employers are “on notice” of its content. As such, employers whose practices are inconsistent with the guidance may be less able to avoid liability for their actions, even if well-intended.
This webinar will examine the agency guidance and provide real-world examples and best practices for companies that perform internal Form I-9 audits or that are considering conducting an I‑9 audit. Morgan Lewis lawyers with significant experience in immigration compliance matters will cover these and other topics in a one-hour web-based presentation:
  • Avoiding charges of discrimination when conducting an internal Form I-9 audit
  • Making effective and appropriate corrections to deficient I-9 forms
  • Handling significant deficiencies in the proper manner
  • Dealing with missing photocopies of I-9 evidence documents
  • Handling the issue of existing employees whose employment eligibility is called into question through problematic documents, an admission, or a tip
  • Dealing with issues related to failing to properly E‑Verify an existing employee
