ABA 22nd Annual Philadelphia Tax Conference

Senior counsel Joe Ronan (panel chair) and partner David Fuller (speaker) will participate in a panel discussion titled "Employee Benefits: Tax Issues in the Employee/Independent Contractor Debate" at the ABA 22nd Annual Philadelphia Tax Conference.

This panel will provide an update on the current status of the tax issues surrounding the classification of workers as independent contractors or employees. We will review the current criteria applicable to employee classification and current federal enforcement efforts such as the recently announced IRS-DOL joint initiative. The panel will discuss various statutory tax relief provisions (such as Section 530 relief and Section 3509 relief) and various administrative relief programs (such as the Classification Settlement Program ("CSP") relief and the recently announced Voluntary Classification Settlement Program ("VCSP")). The discussion will include the differences between the programs and which relief programs employers will find the most beneficial to their business operations. Some time will also be spent on related issues such as employee fringe benefit/health coverage issues.
