False Claims Act (FCA) prosecutions and recoveries scored big headlines in 2011.
With more cases initiated in 2011 than in any prior year before - 638 qui tam actions and 124 cases initiated by the United States without the aid of a relator - False Claims Act (FCA) prosecutions and recoveries scored big headlines. In fact, recoveries amounted to $3.03 billion in 2011, only slightly less than the $3.09 billion recovered in 2010. It's expected that FCA recoveries will make a huge leap in 2012 to ultimately total close to $9 billion.
Investigations and settlements originating from these proceedings pose litigation, risk management, and compliance challenges for all industry sectors, as recent amendments to the statute introduce new theories of liability and authorize new government and whistleblower investigative techniques.
