Welcome to the era of transparency. CMS has issued proposed regulations to implement Section 6002 of the Patient Protection and Affordable Care Act (ACA), popularly known as the U.S. Sunshine Act. Pharma, device, and biologic companies as well as certain suppliers and vendors now have a legal obligation to report payments or other transfers of value $10 or higher per transaction or $100 in the aggregate for the calendar year made to a covered recipient, which includes physicians or teaching hospitals. The law covers bagels, Starbucks, certain CME activities, medical director agreements, royalty agreements, research grants and charitable donations, among many other interactions between health care professionals and industry. The reported payments will be publicly available for review on the CMS website.
