Davidson will present "The Brave New World of Provider Litigation Under ERISA: How Plaintiffs' Class Action Lawyers Transform Pay and Reimbursement Disputes Into Purported ERISA Claims and How to Defeat Them" as part of the Blue Cross and Blue Shield Association's 47th Annual Lawyers' Conference.

Presentation description:

As a non-enumerated party, how does a provider find standing to sue under ERISA?  Does non or underpayment to the provider translate to member/participant injury? How should internal provider appeals procedures interact with ERISA claims procedures? So what is an "adverse benefit determination" anyway? How does ERISA preemption come into play?  Where does the DOL come out on this? What are the class action issues and how to defeat class claims? Are there early exit strategies to potentially limit the cost of defense and plaintiffs' leverage for imposing too-expensive resolutions?  How can the plaintiffs' remedies claims be limited?

The Blue Plan Legal Department Cooperative's CLE Coordinator, Ms. Keyanna Watson-Blackmon, will apply for credit for this conference in all states with mandatory CLE requirements.  After the conference, she will provide each registrant (licensed in a state(s) with mandatory CLE requirements) with a record of the filing she has made on your behalf to your state's CLE accrediting/compliance authority.
