Electronically Stored Information (ESI) is ubiquitous and crucial in international cartel cases. Often multinational companies caught up in such matters must manage huge amounts of ESI, located in different countries, written in multiple languages, and on different media. This panel will address legal, practical, and forensic issues involving ESI at each critical step in the life of a hypothetical international cartel case: dawn raids/search warrants, grand jury subpoenas, leniency and other cooperation agreements, civil discovery and litigation, post-indictment criminal discovery, and civil and criminal trials.
