Pension benefit plan overpayments and underpayment are increasingly the subject of litigation. This is especially true due to the fiduciary responsibility that may arise from such administrative errors. This teleconference will review the increasing incidents of pension plan overpayments and underpayments and the competing responses under ERISA and IRS guidance. What are the responsibilities of plan fiduciaries to prevent errors or uncover them before distributions to participants? What remedies do participants have when they are assessed with overpayments? What does the IRS really have to do with this?
