2016 IP Academy Series: Patentable subject matter

Last month, the US Supreme Court denied a petition to review the US Court of Appeals for the Federal Circuit’s determination of patent-ineligibility in Ariosa Diagnostics, Inc. v. Sequenom, Inc. In recent months, however, the Federal Circuit overturned district court decisions that certain patents were directed to patent-ineligible subject matter, which has finally shed some light on what would be determined patent-eligible rather than patent-ineligible.
