Design patents protect the ornamental appearance of a product. Historically glossed over as providing little value and limited scope of protection, recent changes in the law are allowing for design patents to play an important role in a company’s IP portfolio. Although design patents can be a powerful tool in addition to or in place of utility patent protection, there are a number of issues that applicants should consider to maximize the value of their filings.
