This month’s Fast Break webinar will explore the expanding focus on individual accountability in government enforcement matters.

The 2015 memorandum by former Deputy Attorney General Sally Yates signaled a renewed interest in pursuing individual accountability for corporate wrongdoing and this emphasis has been pronounced in recent civil fraud settlements under the False Claims Act for individual liability against a Board of Director Chairman, Chief Executive Officers and a Senior Vice President of Reimbursement. DOJ has changed its civil enforcement policies and investigation tactics to pursue individuals and this impacts investigation strategies as well as governance safeguards. Other enforcement agencies with exclusion and debarment power have staffed to pursue individual cases as well. This webinar will explore:

Topic will include:

  • Recent cases of individual corporate liability;
  • Officer, director and employee representation issues in government investigations;
  • Settlement and litigation issues to assess when the CEO, Board and Company are all on the hook;
  • Pro-active strategies to manage individual Board liability for corporate wrongdoing.
