The 2015 memorandum by former Deputy Attorney General Sally Yates signaled a renewed interest in pursuing individual accountability for corporate wrongdoing and this emphasis has been pronounced in recent civil fraud settlements under the False Claims Act for individual liability against a Board of Director Chairman, Chief Executive Officers and a Senior Vice President of Reimbursement. DOJ has changed its civil enforcement policies and investigation tactics to pursue individuals and this impacts investigation strategies as well as governance safeguards.
