The US Department of Justice (DOJ) recently announced its first enforcement action for “no-poaching” agreements since the landmark antitrust guidance, Antitrust Guidance for Human Resource Professionals, was issued in October 2016. Additional criminal and civil investigations remain pending and are expected to be announced in the near future.
