Insurance recovery partner Jay Konkel will speak at the 2020 Insurance Coverage Litigation Committee CLE Seminar on the March 5th, 1:25 PM breakout panel "Can Coverage Counsel Make Whoopee with Non-Cumulation Language?".
Using the format of the Newlywed Game, this panel will discuss various aspects of non-cumulation language in insurance policies.

- What is the purpose of a prior insurance and non-cumulation provision?
- What does the term “loss” mean in a prior insurance and non-cumulation provision?
- How does one determine if a “loss” is “covered” by a prior policy?
- How does one determine whether there are “amounts due” under prior insurance?
- Under various coverage and language scenarios, assess potential liability for insurers and insured for different claim types.
