The COVID-19 crisis has created unforeseen and unavoidable circumstances in healthcare delivery that has compelled the Department of Health and Human Services to expand the Public Readiness and Emergency Preparedness Act (PREP) for certain COVID-19 medical countermeasures by licensed healthcare professionals and for certain covered persons and entities. Some States similarly have issued immunity orders for COVID-19 related circumstances or have proposed immunity legislation. Even limited immunity that excludes gross negligence and willful conduct is controversial and may prove an illusory protection from liability assertions from many different stakeholders. 

This webinar will explore the scope of the PREP Act and State immunity orders and what impact these limited governmental immunities may have on tort, regulatory and enforcement exposures for the health industry and what risk management actions make sense now.
