Think Tank for Redactions
- If the rules for the scope and procedures for redactions in discovery were being re-written today, what would they look like?
- In this session, you will:
- Analyze the current state of redactions, including the allowable scope (privilege and statutory, i.e., HIPAA, Bank Privacy, etc.) and the burden in preparing logs
- Discuss whether the scope of redactions should be expanded, perhaps to include redactions for:
- relevancy
- confidentiality
- trade secret and proprietary information
- privacy and data protection (i.e., PII, international protections)
- Consider proposed methods to reduce the burden of redactions, including a proposal for creation of a “502(d)” equivalent for redactions
