On 4 December 2020, the UK government launched a consultation on (1) measures to extend the ban on exclusivity clauses in contracts of employment and (2) measures to reform post-termination noncompete clauses in contracts of employment. In parallel, the new US administration has indicated support for similarly broad reform measures at the federal level. This will likely raise numerous compliance questions and practical issues, particularly with pressure on labor market restrictions.

Please join partners from the Morgan Lewis antitrust and employment teams for a webinar discussing legal considerations, best practices, and issues for UK and US employers to monitor as the new rules begin to take shape.

TOPICS WILL INCLUDE:

  • An overview of the UK consultation and implications from a UK and US employment and antitrust law perspective
  • Ongoing factors to consider from an employer’s perspective
  • The US perspective including state law developments further limiting noncompete agreements and antitrust risks with no-poach agreements
