Creating Clarity Out of Chaos: Navigating the Murky Waters of FCA Enforcement

This session will explore recent developments in the law and defense strategy under the civil False Claims Act. These include critical questions as to how the concept of causation applies in kickback cases, and how courts and litigants address materiality in the wake of the Supreme Court's seminal opinion in Escobar. Because regulatory guidance often fails to keep up with potential FCA issues with evolving industry practices, defendants face uncertainty and potential significant liability for conduct stretching back many years. The panelists will discuss opportunities for greater clarity in guidance to help encourage rather than inhibit innovation.
