In late 2021, the US Department of Justice (DOJ) announced its Civil Cyber-Fraud Initiative as part of its effort to combat cybersecurity issues and hold companies and individuals accountable for putting government information or systems at risk. This initiative is part of the Biden-Harris administration’s May 2021 executive order to modernize cybersecurity. It will greatly impact the healthcare industry, especially healthcare government contractors and service providers.

In this month’s Fast Break, we will be joined by Mark Krotoski and Katie McDermott to discuss these cybersecurity initiatives and how they relate to whistleblowers, the role of the False Claims Act, and what healthcare organizations can do now to mitigate risks as enforcement and litigation ramp up in 2022.

Topics will include:

  • Background on the current cybersecurity initiatives
  • False Claims Act legal decisions that may be used to support liability for cybersecurity risks or incidents
  • The DOJ’s invitation for cyber expert whistleblowers to assist the initiative and whistleblower management tips
  • Important measures to take for managing cybersecurity risks
  • Steps on conducting a cyber investigation following an incident
