Mark Krotoski spoke as part of a panel focusing on "Extradition and Antitrust: Where Are We Now?" presented by the ABA Section of Antitrust Law Cartel & Criminal Practice Committee.
Before 2014, many questions were raised regarding the Antitrust Division’s ability to extradite individuals located abroad. However, multiple successful extraditions since 2014 and recent statements by Assistant Attorney General Bill Baer have made it clear that the risk of extradition is greater than ever for criminal antitrust defendants outside the United States.
This program provided a helpful overview and discussion of the current state of U.S. extradition law, policy, and practice in criminal antitrust cases, with a special focus on Japan, Korea, and Canada.
