“Relieve Your ACA-High Anxiety”
Now that the final rule under the Affordable Care Act (ACA) employer shared responsibility mandate has issued, it’s time for employers to finalize their strategy for compliance or face potential penalties. While the final regulations include some important transition relief, large employers will still be required to comply substantially with ACA requirements in 2015. This session will address new developments outlined in the final regulations, including how to determine and measure hours for various categories of employees, including part-time, temporary, seasonal and other special groups. We will discuss the issues faced when employees are re-hired and when they change categories of employment (i.e., move from part-time to full-time, etc.). We will also discuss the newly issued final rule on the 90 day waiting period limitation. Additionally, we will address the new potential areas for liability associated with these rules, including ERISA Section 510 and FSLA whistleblower claims. The session will provide practical suggestions to limit liability and to comply with ACA requirements.
