Excluded: Strategies for Maximizing the Effectiveness of an ITC Exclusion Order – Or Redesigning Your Way Around One

Over the last five years, the ITC has issued more than 50 exclusion orders, including 14 general exclusion orders, restricting access to the US market for a broad swath of companies and industries. Successfully obtaining an exclusion order, however, is only half the battle. Both the ITC and US Customs offer independent avenues to either enforce, or work around, an existing exclusion order.
